The Uttar Pradesh cabinet, in a decisive move, approved an ordinance aimed at staunchly preventing question paper leaks and unauthorized means during examinations. This initiative follows recent instances of question paper leaks in key exams such as the state police constable recruitment and the Public Service Commission tests for review officers and assistant review officers.
Chief Minister Yogi Adityanath chaired the state cabinet meeting, during which the ordinance received unanimous support. According to Finance Minister Suresh Khanna, who briefed reporters after the meeting, the ordinance stipulates severe penalties for offenders involved in question paper leaks. Offenders can face imprisonment ranging from two years to life, along with hefty fines extending up to Rs 1 crore
Khanna clarified that the ordinance applies to a wide range of exams conducted by various bodies, including state Public Service Commissions, subordinate service selection boards, Uttar Pradesh Boards, universities, and affiliated institutions. This includes recruitment, regularization or promotion exams, as well as entrance exams for degrees, diplomas, and educational certificates.
The state government is committed to ensuring exam integrity and fairness in selection processes in Uttar Pradesh.
According to this ordinance, distributing fake question papers and creating fraudulent employment websites are considered punishable offences, as stated by Khanna. He mentioned that if the examination is compromised, financial responsibility will be imposed on the "paper-solving gang" and the institution.
Those service providers found to be engaged in irregularities during the examination will be permanently blacklisted., and their property could also be confiscated. All the offences under the ordinance are cognizable and non-bailable, and they can be heard in the session court. Strict provisions have also been made regarding bail, he added. The minister has proposed an ordinance since the assembly is not currently in session.
After the cabinet approves the proposal, the ordinance will be implemented. It is being introduced in response to urgent necessity and will be enacted under the provisions of the Constitution.
The move also comes at a time when the issue of alleged irregularities in the NEET-UG and UGC-NET exams is raging in the country.
All offences under the Uttar Pradesh Public Examination (Prevention of Unfair Means) Ordinance have been made cognizable and non-bailable. The offences will be tried by session courts and will be non-compoundable. The ordinance also includes strict provisions for bail. Apart from jail terms and fines, provisions have also been made under the ordinance for the property of those found involved to be attached.
The ordinance applies to exams conducted by Uttar Pradesh Public Service Commission, UP Subordinates Service Selection Board, UP Board, state universities, and nominated entities, as mentioned by a government spokesperson
It will also cover exams for regularisation and promotion in government jobs. Under the ordinance, offences such as distributing fake question papers and creating fraudulent employment websites are also punishable.
After the Lok Sabha elections, Chief Minister Yogi Adityanath announced plans to introduce a law to prevent paper leaks and take strict action against the gangs involved.
