Can an LL.B Graduate Be Enrolled as an Advocate Without Completing a Bachelor's Degree?

The recent case of Inderpal Singh v. Himachal Pradesh University & Ors highlights the importance of adhering to eligibility criteria for professional courses. In this case, the Himachal Pradesh High Court denied the enrolment of Inderpal Singh as an advocate because he had obtained admission to a three-year LL.B course before completing his B.A degree. Justice Jyotsna Rewal Dua upheld the decision of the Himachal Pradesh Bar Council, stating that it was within their powers and jurisdiction under the Advocates Act and the Bar Council of India Rules to refuse Singh’s enrolment.

Inderpal Singh had taken admission to the LL.B program at Mata Bala Sundri College of Legal Studies in June 2014 without having passed his B.A exam. He only received his B.A marks certificate in July 2015, several months after starting his law course. Despite completing his LL.B in 2017 and receiving a provisional certificate from Himachal Pradesh University, Singh's application for enrolment as an advocate was rejected by the Bar Council.

The court noted that Singh was aware of the eligibility requirement to complete his B.A before enrolling in the LL.B program and had even given an undertaking regarding his provisional admission. The court found that Singh’s simultaneous pursuit of both degrees was impermissible and that the University had issued the LL.B certificate in good faith, not knowing the irregularities in his admission process.

Singh’s subsequent petitions, including a claim for ₹5 crore in damages from the University, College, and Bar Council, were dismissed by the court. The court reiterated that a Bachelor's degree is mandatory for admission to the LL.B course and that Singh’s case did not meet this fundamental requirement. However, the court allowed Singh the liberty to seek appropriate legal remedies for his damages claim.

The case, represented by Advocates Atharv Sharma for the petitioner, Uday Shurya Kaushik, Nitin Thakur for the University, and Senior Advocate VS Chauhan and Advocate Bhanvi for the college, underscores the strict compliance needed with educational qualifications and the repercussions of not adhering to them.
