Court Rejects Plea to Quash FIR in Rape Case Amidst Settlement Offer

In a significant ruling, the Delhi High Court, under Justice Swarana Kanta Sharma, has firmly asserted that justice cannot be compromised through financial transactions in cases involving allegations of sexual assault. The court's decision came in response to an accused individual's attempt to settle a rape accusation by offering monetary compensation to the victim in exchange for withdrawing the 

FIR.Background of the Case:-

The case revolves around a single mother who alleged that she met the accused on a social media platform where he misrepresented himself as a divorced man. According to her complaint filed in February 2020 at the Mehrauli police station, the accused allegedly drugged and assaulted her during a time when her child was not present. Additionally, she accused him of taking advantage of her under false pretences of love and marriage, even going as far as creating intimate photographs and videos without her consent.

 Legal Proceedings and Arguments:-

The accused, subsequently, approached the High Court seeking to quash the FIR by claiming an amicable settlement with the victim, wherein she agreed to accept ₹1.5 lakh in lieu of withdrawing the complaint. His counsel argued that the relationship was consensual, and the FIR was filed out of anger, with no intention to pursue legal action further.

Court's Observations and Decision:-

However, Justice Swarana Kanta Sharma dismissed the plea, emphasizing the seriousness of the allegations which include continuous instances of severe sexual violence, threats against the victim's life, and misleading representations by the accused about his marital status. The judge highlighted that these allegations merit a fair trial to ascertain the truth, stressing that justice cannot be undermined or equated with financial settlements.
