Delhi's First BNS FIR: Street Vendor Charged for Encroachment



A complaint was lodged against a street vendor for reportedly blocking the foot over bridge marks the initial application of the new penal code BNS, with the vendor being charged for encroachment.

 

About the Incident

A complaint was lodged against a 23-year-old street vendor for allegedly obstructing the foot-over bridge at New Delhi Railway Station by selling tobacco, water, and other items from a cart, the following incident, occurred shortly after the implementation of the Bharatiya Nyaya Sanhita (BNS) on July 1, marks a significant shift from colonial-era laws to new criminal legislation in India.

 

About New Laws

The BNS, along with the Bharatiya Nagrik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam, replaced the IPC, CrPC, and Indian Evidence Act, the BNS comprises 358 sections and introduces new offences, increased prison sentences for certain crimes, higher fines, and minimum punishments for others and also includes provisions for community service penalties.

 

Relevant Provision Involved

In this particular case, the FIR was filed under Section 285 of BNS, which deals with obstructing public ways or lines of navigation, Sub-Inspector Kartik Meena, the investigating officer, reported that despite warnings, Kumar persisted in his vending activities, leading to the complaint and subsequent legal action.
