The Hon'ble Supreme Court held that the essential qualification for the post of Primary School teacher is Diploma in Elementary Education. 
The Supreme Court upheld the judgement of the Chattisgarh High Court which quashed the appointments of Primary School teacher, as the reason they held only B.ED degree, and not a Diploma in Elementary Education. 


Chattisgarh High Court's judgement 

The petition was filed by the Diploma holders in the Elementary Education, which challenged the eligibility of the B.ED candidates. 

The Chattisgarh High Court declared all candidates ineligible for the post of Primary School teacher who were only B.Ed degree holders, following the judgement given in Devesh Kumar vs Union of India (2003).


The group of B.Ed Candidates argued that B.Ed is one of the qualification for appointments under the Chattisgarh School Education Services (Educational and Administrative Cadre) Recruitment and Promotion Rules, 2019.

It is that the appointment orders were issued after the judgement of Devesh Kumar was passed ,so the Hon'ble High Court in an interim order kept the recruitment process in suspension.

This interim order was challenged before the Suprme Court on 29th-August'2023,where the Supreme Court uplifted the stay and allowed the recruitment of B.ED candidates subject to the judgement to be delivered by the High Court. 

Here, the petition was decided in the favour of the Diploma holders.


The order of the 29th August given by the High Court was challenged in the Hon'ble Supreme Court by the group of B.ED degree holders who's appointments were quashed.

The Argument:

The Advocate from the petitioner's side argued that there exists a small window for B.ED degree holders.

The Hon'ble Supreme Court argued that Devesh Sharma's judgememt did not open any kind of Window for B.ED degree holders and also affirmed that only B.Ed is not a sufficient qualification for the post of primary school teacher .Only those candidates were saved who were recruited before the judgement was passed in the Devesh Sharma's case. 


But here the question arises what was the judgement passed in Devesh Sharma vs Union of India (2003)

A bunch of petitioner challenged the judgement passed by the Rajasthan High Court in which it said that Diploma in Elementary Education is important for the post of primary school teacher and only B.Ed would not suffice ,the counter question came that in 2018 a notification of National Council for Teachers Education has come which showed that B.Ed is a one of the eligibility to qualify for primary school teacher.


                 The Supreme Court in the judgement of Devesh Sharma vs Union of India ,2023 affirmed the findings of the Rajasthan High Court and quashed the notification of National Council for Teachers Education brought up in 2018.

                  The bench opined that article 21A provides Right to Education and it is also mentioned in Right to Education Act ,2009 which says that education is not only free and compulsory for the childrens below 14 years of age but it also includes 'quality education' to be imparted among the children.

                    The Supreme Court court held that B.Ed degree holders do not pass the basic requirement of pedagogical threshold for teaching primary school childrens and as a consequence they would not be able to provide the quality education to the children as affirmed by the Supreme Court.
